1 General

1.1 The following privacy policy is intended to inform our customers and all users of the www.appex.ch website about the collection, processing and use of their personal data.

1.2 Applied Experience GmbH, Steinstrasse 20, 5406 Baden-Rütihof, Switzerland (“Applied Experience”), is the provider of the services on www.appex.ch and the responsible party according to the Data Protection Act.

1.3 Applied Experience collects, processes and uses personal data solely in accordance with the content of this privacy policy and applicable Swiss data protection regulations, where applicable, the provisions of the EU General Data Protection Regulation.

2 User Data / Collection / Use

2.1 If you wish to use our services, the data we need to provide and control the services will be collected during registration. By registering, you give us your consent to collect all data according to your registration. This applies in particular to:
– Name and address of the customer / user
– Surnames and first names of contact persons
– e-mail address
– telephone number
– Agreed uses / services

2.2 Applied Experience also collects, processes and stores such personal data that you have voluntarily provided (e.g. in forms or otherwise on the website operated by Applied Experience) in electronic or other communication and that Applied Experience needs to provide and control the Services.

2.3 In the event that you contact Applied Experience – for example, via a contact form or by email – your information will be stored for the purpose of processing your request. This also applies in the event that follow-up questions arise.

2.4 In the context of the services offered, Applied Experience also stores detailed data on your experiences, challenges and questions in the database. This data is not personal data. Rather, it is non-personalized project data that you provide to us for the services we offer.

2.5 In order to enable the use of Applied Experience’s services and website, Applied Experience then collects the following data about the User’s access: the date and time of the website access, the amount of data transfer, the originating location of the access, the type and version of browser used, the operating system of the User’s terminal device, the URL of the previously visited website, the IP address, information about the User’s account.

2.6 Applied Experience stores the collected personal access data of customers and users only for the limited duration of the use of Applied Experience’s services or the duration of the service packages and their subsequent administration.

2.7 Applied Experience uses the personal data provided by you only to provide the services requested by you, ensuring the control of compliance with the “Terms and Conditions”, to answer inquiries, for statistical purposes and to optimize the offer.

2.8 In order to maintain ongoing customer relations, it may also be necessary for us to use personal data to inform you about our offers.

2.9 Applied Experience will not disclose the personal data of the customer / user unless the customer / user has expressly consented to the disclosure or Applied Experience is entitled or obligated to disclose such data due to legal provisions or court orders.

3 Use of Cookies for Website Usage

3.1 Applied Experience also collects data through the use of so-called browser cookies and from the user’s local browser memory. Cookies are small text files that store settings and data on the data carrier of the access device for exchange with the website of Applied Experience and are transmitted with each access. These allow Applied Experience’s website to recognize the identity of the accessing device and make any preferences immediately available. Browser memory is a way to store data on the access device’s disk that the website can access during the visit.

4 Google Analytics

4.1 Applied Experience uses Google Analytics. Google Analytics is a web analytics service provided by Google, Inc (“Google”). Google Analytics uses “cookies”, which are text files placed on your computer, to help the website analyze how users use the site. The information generated by the cookie about the use of this website (including the IP address of the user) will be transmitted to and stored by Google on servers in the United States. Google will use this information for the purpose of evaluating your use of the website, compiling reports on website activity for website operators and providing other services relating to website activity and internet usage. Google may also transfer this information to third parties where required to do so by law, or where such third parties process the information on Google’s behalf. Google will not associate the IP address of users with any other data held by Google. By using the website, users consent to the processing of data about them by Google in the manner and for the purposes set out above.

Applied Experience uses cookies to carry out remarketing measures. In doing so, the Google Analytics cookie is used to serve ads about Applied Experience products within the Google Display Network. You can disable Google Analytics advertising features through Ads Settings, Mobile App Ads Settings, other options such as NAI consumer opt-out, or via Google browser addon.

5 Place of data storage / data security

5.1 The data transmitted to us is stored either on our server located in Switzerland or on the servers of our contract partners specialized in this (currently Swisscom) in accordance with their General Terms of Contract.

6 Rights of the user

6.1 Right to information

The customer / user has the right to know the personal data concerning him, their origin, which transfer has taken place and the purpose of storage from Applied Experience.

6.2 Right of deletion and / or blocking

The Customer / User has the right to request the deletion and/or blocking of personal data stored about him/her at any time, unless Applied Experience has a legal obligation to retain such data. As far as this includes such personal data that are necessary for the provision of services to the Customer, the deletion or blocking of this data can only take place when the Customer no longer uses the offer of Applied Experience and the contractual relationship has been completely settled.

6.3 Right of Revocation

All consents given by the Customer / User for the use of personal data may be revoked by the Customer / User at any time.

6.4 Right to surrender

Finally, customers / users have the right to receive their personal data originating directly from them. Upon explicit request, we will provide this data in a machine-readable and structured format.

7 Modification of the Privacy Policy

Applied Experience reserves the right to make changes to the Privacy Policy at any time with effect for the future. All users are requested to regularly inform themselves about the current privacy policy.

8 Legal basis

This Privacy Policy is based on the provisions of the Swiss Federal Law on Data Protection (DSG) and the Ordinance to the Federal Law on Data Protection (VDSG).

9 Applicable law and place of jurisdiction

The use of our services and our website is subject to Swiss law. The exclusive place of jurisdiction is Baden, AG, Switzerland.
